    Beema Health LLC (“Beema Health,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit beemahealth.com, join our waitlist, use a Beema Health patient portal, communicate with us, or use any website, application, product, or service that links to this Privacy Policy (collectively, the “Services”).

    This Privacy Policy should be read together with our Terms of Service, Telehealth Consent, and any Notice of Privacy Practices provided by a healthcare provider or medical group involved in your care.

    1. About Beema Health and the Services

    Beema Health operates a telehealth platform that connects patients with independently licensed healthcare professionals and other organizations involved in providing healthcare services.

    Beema Health is not a replacement for your primary care provider and does not provide emergency medical services. Clinical services are provided by independently licensed healthcare professionals or medical groups (“Providers”). Providers exercise independent medical judgment and are solely responsible for determining whether treatment is medically appropriate.

    We may also work with pharmacies, laboratories, payment processors, technology providers, fulfillment providers, and other service partners (“Care Partners”) to facilitate the Services.

    Providers, medical groups, pharmacies, laboratories, and other Care Partners may maintain their own privacy policies or Notices of Privacy Practices. Their handling of information may be governed by those notices in addition to this Privacy Policy.

    We disclose information to Providers and medical groups to evaluate treatment eligibility, provide healthcare services, communicate with you, issue prescriptions, monitor treatment, and conduct treatment, payment, and healthcare operations.

    We disclose information necessary to process prescriptions, conduct testing, dispense medication, coordinate shipping, provide refill support, and resolve fulfillment issues.

Depending on the applicable state law, allowing an advertising or analytics provider to collect online identifiers from public pages may be considered a “sale,” “sharing,” or processing for targeted advertising even when no money is exchanged.

    We do not permit advertising platforms to use the contents of medical intake forms, Provider communications, diagnoses, medications, laboratory results, prescriptions, or authenticated patient-portal activity for their own advertising.

    Where required by law, we will obtain consent before sharing consumer health data or sensitive personal information for a purpose that is not necessary to provide a service you requested.

Where legally required and technically supported, we also process recognized universal opt-out signals, such as Global Privacy Control, as a request to opt out for the browser or device sending the signal.

    Please identify the privacy right you wish to exercise and provide enough information for us to locate your records. We may verify your identity before completing the request. We will use personal information provided for verification only to verify and process the request.

    13. HIPAA and Protected Health Information

    HIPAA applies only to covered entities and their business associates. It does not apply to every organization or every type of health-related information.

    Providers and medical groups may be HIPAA-covered entities. Beema Health may act as a business associate when it handles protected health information on behalf of a covered entity. When acting as a business associate, Beema Health uses and discloses protected health information only as permitted by HIPAA, an applicable business associate agreement, and other law.

    A Provider’s or medical group’s Notice of Privacy Practices describes how that organization may use and disclose protected health information and explains the applicable HIPAA rights. If this Privacy Policy conflicts with a Provider’s Notice of Privacy Practices regarding protected health information controlled by that Provider, the Provider’s Notice of Privacy Practices will control.

    Information maintained by Beema Health outside its role as a business associate may not be protected by HIPAA but may still be protected by other federal or state privacy laws and this Privacy Policy.

    Information properly de-identified under HIPAA is not protected health information. More information about HIPAA privacy rights is available from the U.S. Department of Health and Human Services.

    14. Security and Breach Notification

    We maintain administrative, technical, and physical safeguards designed to protect personal information. Depending on the system and information involved, these safeguards may include:

    Clinical, prescription, and billing records may be retained for periods established by the Provider, pharmacy, medical group, or applicable law. Beema Health may not be able to delete records controlled by those organizations.

    When information is no longer reasonably needed, we may delete, destroy, anonymize, or de-identify it using appropriate safeguards. Information stored in backups may remain until the backup is securely overwritten or deleted, subject to applicable law.

    16. Children’s Privacy

    The Services are intended for adults who are at least 18 years old. Individuals under 18 may not create an account, complete a medical intake, or use the Services unless a specific Service expressly permits it and all required parental or legal-guardian consents are obtained.

    We do not knowingly collect personal information from children under 13 through the Services. If you believe a child has provided personal information to us improperly, contact support@beemahealth.com.

    17. Third-Party Websites and Services

    The Services may contain links to websites, applications, social-media platforms, pharmacies, laboratories, or services operated by third parties.

    We do not control and are not responsible for the privacy, security, content, or practices of third-party services. A link does not mean that Beema Health endorses the third party’s privacy practices. Review the applicable third party’s privacy policy before providing information.

    18. United States Operations

    Beema Health is based in the United States, and the Services are directed to individuals located in the United States.

    Information may be processed in the United States and in other locations where our service providers operate. When required, we use appropriate safeguards for transfers of personal information.

    19. Changes to This Privacy Policy

    We may update this Privacy Policy to reflect changes in the Services, technology, legal requirements, or our information practices.

    When we update the Policy, we will revise the “Last updated” date. If a change materially affects how we collect, use, or share sensitive personal information or consumer health data, we will provide additional notice and obtain consent when required.

    Your continued use of the Services after an updated Policy becomes effective constitutes acknowledgment of the updated Policy, but it does not replace any consent required by law.

    Prices, discounts, promotions, medication costs, consultation fees, subscription rates, and other offers displayed on our website or in advertisements are subject to change at any time, subject to applicable law and any express written terms governing an existing purchase or subscription.

A price is guaranteed only when Beema Health expressly states the duration of that guarantee in written offer or subscription terms.
